1. About these terms
These Terms of Service govern your use of BusyBack, an AI phone answering service operated by Wonderfiire ("we", "us", "our"), trading as BusyBack, based in Brisbane, Queensland, Australia. By signing up for or using BusyBack, you agree to these terms.
If you're agreeing on behalf of a business, you confirm you have authority to bind that business.
2. The service
BusyBack provides:
- A dedicated Australian phone number assigned to you
- An AI that answers calls to that number when forwarded by you
- An SMS summary of each call sent to your nominated mobile number
- A web dashboard for reviewing calls, recordings, and account settings
We operate the service on a "best effort" basis. We don't guarantee 100% uptime and we don't guarantee the AI will always understand or correctly capture every detail of every call.
3. Pricing and billing
- Number subscription: $5 AUD per month, charged monthly via Stripe
- Per-call fee: 95ยข AUD per call answered by the AI, deducted from your prepaid balance
- Top-ups: $9.50 AUD adds 10 calls to your balance; larger bundles available with discounts
- GST: all prices listed include GST where applicable
You authorise us to charge your nominated payment method for the monthly subscription and any top-ups you initiate. Payment failures will pause your service until resolved.
4. Acceptable use
You agree not to use BusyBack to:
- Receive calls related to illegal activities
- Conduct outbound robocalls or unsolicited marketing campaigns
- Impersonate another business or person
- Reverse engineer, scrape, or copy the service
- Generate excessive call volume designed to consume capacity rather than serve genuine callers
We may suspend or terminate accounts that breach these rules. Where the breach is serious, we may do so without notice.
5. Your responsibilities
- You are responsible for keeping your account login details secure
- You are responsible for the conduct of any users you authorise on your account
- You are responsible for ensuring you have permission to receive calls at the BusyBack number assigned to you (e.g. you have set up call forwarding lawfully)
- You are responsible for any disclosures to your callers about how their call information is handled (see also our Privacy Policy)
6. Cancellation
You can cancel at any time by logging into your dashboard or replying CANCEL to any BusyBack SMS. There are no exit fees and no minimum term. Cancellation takes effect at the end of your current billing period. Prepaid call balances are non-refundable but remain available for use until the end of the billing period.
7. Refunds
Monthly subscription fees are non-refundable. Where we have charged you in error, or the service has been materially unavailable for an extended period that was our fault, contact us and we will issue a fair pro-rata refund. This does not limit your rights under the Australian Consumer Law.
8. Intellectual property
The BusyBack service, software, and brand are owned by us. You retain ownership of any content you submit (e.g. custom prompts, business details). By using the service, you grant us a non-exclusive licence to use that content as necessary to deliver the service to you.
Call recordings and transcripts are jointly held โ we use them to deliver the service and to improve the AI; you can request deletion of your records at any time per our Privacy Policy.
9. Service availability
We aim for high availability but don't promise uninterrupted service. Maintenance, third-party outages (e.g. Twilio, Google), and unforeseen technical issues may cause downtime. We will publish notices for planned maintenance where possible.
10. Limitation of liability
To the extent permitted by law, our total liability to you arising out of or in connection with the service is limited to the total fees you have paid us in the three months preceding the event giving rise to the claim.
We are not liable for indirect, incidental, special, consequential, or exemplary damages, including lost profits or lost revenue, even if we have been advised of the possibility of such damages.
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.
11. Indemnity
You agree to indemnify us against any third-party claim arising from your misuse of the service or breach of these terms, including claims by your callers regarding how their information was handled at your direction.
12. Changes to these terms
We may update these terms from time to time. The "Last updated" date at the top of this page will reflect any changes. We will notify you of material changes by email or SMS at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance.
13. Governing law
These terms are governed by the laws of Queensland, Australia. Any dispute is subject to the exclusive jurisdiction of the courts of Queensland.
